Everyone has been calling the rumored Apple cell phone the iPhone. But, the name iPhone is already taken. The iPhone is a VoIP Internet service being offered by Nuivo since 2003. However, Apple had registered for the iPhone trademark way back in 2002. So will Apple end up naming it the iPhone, or can't they because it doesn't constitute a different enough use of the name to not infringe on Nuvio? Will Apple have to name it something different such as iCell or iTalk? We'll just have to wait and see.

Any links? I couldn't find anything regarding a link between Nuivo and the name iPhone in a quick google search.

If Apple registered the iPhone trademark before Nuivo, then Nuivo would be committing trademark infringement. If anything, Nuivo could be forced to rename their product or pay Apple a large licensing fee for that name.

i dont think they will name it "iTalk"
cause, if i can remember, they have some sort of apple ipod accessory named that [i think for recording]

and so..what Psychosis said, isnt that like "illegal"?
